Snap Loan Terms of Use

The big picture

If your application to us is successful we will lend you money, and you will be issued with a virtual card ("Snap Loan"). You can use the Snap Loan to:

  • purchase from the retailers we have agreed with you;
  • up to the limit of the amount we are prepared to lend to you.

To make that happen there are a number of documents that set out the contractual position:

  • The loan document
  • The card issuer terms issued by the card issuer Enfuce UK Limited ("Card Issuer Terms")
  • These Snap Loan Terms of Use

These Snap Loan Terms of Use are in addition to the documents listed above.

Virtual prepayment card

The Snap Loan (virtual card) which will be issued to you by our programme partner Enfuce Limited is NOT a credit card, it is simply a way of allowing you to demonstrate to a retailer the amount of credit we have made available. This document and the Card Issuer terms set out how the virtual card can and cannot be used, the obligations on you, and the commitments to which we and Enfuce Limited are committed.

Card Issuer Terms

The Card Issuer Terms issued by Enfuce Limited set out the basics around the Snap Loan. It is important you read those terms to understand how the Snap Loan can be used and your responsibilities.

The Card Issuer Terms deal with important issues such as:

  • How the Snap Loan can and cannot be used
  • Your obligation to keep the virtual card secure
  • What you need to do if the virtual card (or an electronic device on which it is stored) is lost, stolen or misused
  • What happens if there are unauthorised or disputed transaction and your responsibilities
  • When the virtual card can be suspended or ended
  • How your personal data is handled by the card issuer Enfuce Limited

Restrictions on where you can use the Snap Loan 

You must only use the Snap Loan at the retailers we have specifically agreed with you. If you try to use the virtual card at other retailers you will normally have payment declined, we can terminate your use of the virtual card and we can require repayment of the loan.

The Snap Loan must also only be used for transactions in pound sterling. It must not be used with a retailer to obtain "cashback" and it cannot be used in an ATM to withdraw cash.

Availability

The virtual card will be able to be used like any other payment card using the Visa network. However there is no guarantee that the Snap Loan can be used at any particular time – there are complex systems that support the payment processes and they can sometimes be disrupted or require maintenance.

Problems or complaints about the goods or the retailer

The arrangement to buy goods from a retailer is between you and the retailer. Therefore if there is a problem with the goods or the retailer then you should complain to the retailer. Your payment obligation to us in relation to the loan will still apply.

If you want to return your purchase and receive a refund then the terms and information provided by the retailer shall apply. When a return is accepted by the retailer then normally the store should issue the refund as a credit to the virtual card. If we receive a repayment from a retailer which is related to your transaction we will credit that payment to the virtual card. Note that if the retailer pays you the refund direct (and not to the virtual card) then you will be liable to pay us the full amount of our loan to us.

Snap Loan and Snap Wallet app security, and unauthorised, disputed or fraudulent transactions

You must notify us and Enfuce UK Limited immediately if you know or suspect that the virtual card (or an electronic device on which it is stored) has been lost, stolen or misused or if there are any unauthorised, disputed or fraudulent transactions. The Card Issuer Terms set out when you might be liable for any such transactions or misuse of the Snap Loan.

Suspension or termination of use of the Snap Loan (virtual card) or the Snap Wallet app

We reserve the right to block the use of the Snap Loan if we have reasonable concerns relating to unauthorised or fraudulent use, security of the virtual card (and the funds loaded onto it), your ability to repay to us the amount loaned or your breach of the Card Issue Terms or the terms of the loan with us.

In addition the Card Issuer Terms set outs when the virtual card can be suspended or ended.

Expiry of the Snap Card

The Snap Loan (virtual card) will expire after 30 days. On the date of expiry any amount remaining on the virtual card will be returned to us and we will treat that amount as a repayment under the loan document.

Transfer

The Snap Loan and virtual card must not be transferred to any other person. It must only be used by you. If you transfer, or lend or provide the virtual card to any person (or we have reasonable grounds to suspect that has happened) then we or the card issuer Enfuce Limited can suspend or terminate the Snap Loan

Liability

The Card Issuer Terms set out limits and exclusions of Enfuce UK Limited's liability to you. Those exclusions and limitations of liability also apply to our liability to you.

Law

These Snap Loan Terms of Use are subject to English law. If you are resident in England or Wales, this Agreement shall be governed by and construed in accordance with the law of England and Wales and the English and Welsh Courts shall have exclusive jurisdiction. If you are resident in Scotland, this Agreement shall be governed by and construed in accordance with the law of Scotland and the Scottish Courts shall have exclusive jurisdiction. If You are resident in Northern Ireland, this Agreement shall be governed by and construed in accordance with the law of Northern Ireland and the Northern Irish Courts shall have exclusive jurisdiction.

Ombudsman Scheme

If you have a complaint about this agreement, the Snap Loan or our service, you can find a copy of our complaints policy on our website at https://www.snapfinance.co.uk/complaints .

If you are a customer acting outside the course of a business and have been unable to resolve your complaint with us, you are entitled to refer it to the Financial Ombudsman Service. The Financial Ombudsman can be contacted by telephone on 0800 023 4567, by writing to them at the Financial Ombudsman, Exchange Tower, London, E14 9SR or by emailing them at complaint.info@financialombudsman.org.uk

If you are a customer entering into this Agreement in the course of a business, you may have the right to complain to the Financial Ombudsman Service.

Our supervisory authority is the Financial Conduct Authority of 12 Endeavour Square, London, E20 1JN.
